These are the terms that govern your relationship with Fortu. The official version is in Spanish — please read carefully before using the app.
Welcome to Fortu (including its subdomains, content, brands and services). Fortu is a brand of FORTU S.A.S, a company incorporated in Colombia, with registration number NIT: 901932643-3 and registered office in Bogotá D.C.
This document (“Terms and Conditions”) or also (“Terms of Use”), together with the Supplementary Game Terms, the Privacy Policy Notice, the Cookie Policy (website) and the Terms and Conditions (hereinafter, the “Terms” or the “Site Terms”), defines the terms and conditions of the agreement between Fortu (“we”, “us”, “our”) and any person who registers and accesses the Site as a registered user (“Player”, “User”, “you”, “your”), and, to the extent applicable, any person who accesses the Site (App) as a visitor. You must carefully read and accept these Terms when registering an account on our application or on the page fortuapp.com. If at any time you do not agree with the Terms, you will not be able to use or continue using the Site (App).
Fortu reserves the right to modify these Terms of Use, including the specific rules of the Services, at any time. In the event of significant changes to these Terms, you will be notified immediately and, before accessing and using your account for the first time following such changes, you will be required to expressly confirm your acceptance of the updated Terms. If, after the changes, you decide not to continue using the services, you may withdraw all your available funds and close your account.
For minor or non-material changes to these Terms of Use, we will make every effort to notify you in a timely manner, although we cannot guarantee this at all times. It is recommended that you periodically review these Terms of Use, checking the date and version number appearing at the top, to ensure that you are consulting the most recent version.
These Terms of Use are published in Spanish and may be available in other languages.
Fortu is legally incorporated with the Bogotá Chamber of Commerce (CCB), the Superintendence of Industry and Commerce (SIC), the National Tax and Customs Directorate (DIAN) and the Data Universal Numbering System (DUNS), and operates as a technological intermediation and agency platform.
At any time, you may verify the status of our registration as follows: to verify whether our company exists in the Bogotá Chamber of Commerce, you may consult the Registro Único Empresarial y Social (RUES). You may also consult files and perform name and trademark searches, as well as access the certificate verification portal on the Bogotá Chamber of Commerce website or through the “Trámites y Consultas” section on the same website.
Fortu operates lottery messaging services as an independent ticket-purchase service and is not associated with or endorsed by Loterías y Apuestas del Estado, nor by any company that administers products for which our services are used. Accordingly, Fortu is not an operator of games of chance, does not sell its own bets, does not collect bets on behalf of operators, and acts exclusively under the instructions of the User.
Nature of the Agency and Intermediation Service. Fortu is a strictly technological and logistics services platform. The User declares that they are aware of, understand, and accept that Fortu does NOT sell lotteries, does NOT exploit or manage games of chance, is NOT an authorized betting operator, and does not issue or resell lottery tickets. Use of the application constitutes an agency and technological intermediation contract, under which Fortu acts solely as the User’s agent, technological intermediary, and provider of messaging and documentary custody services. Under this arrangement, the User expressly instructs the purchase of the selected product; Fortu executes that instruction by acquiring the ticket at a legally authorized point of sale; and the lottery ticket or fraction legally belongs exclusively to the User from the precise moment of its purchase. Fortu acts at all times as a mere holder and custodian of the ticket on behalf of the User, without acquiring any right or participation in the ticket or in any potential prizes.
Purchase Instruction: The User expressly orders, authorizes and empowers Fortu to execute the physical purchase instruction for the lottery ticket or fraction selected by the User from a legally authorized operator or distributor. 2.4.2 Execution and Custody: Fortu acts exclusively as a technological intermediary, messaging manager and documentary custodian. Its function is limited to receiving the digital order, carrying out the physical or digital purchase on behalf of the User, digitizing the receipt for display in the app, and securely holding the physical ticket until the date of the draw or its eventual redemption.
The Site is not intended for persons under eighteen (18) years of age. If you are under 18 years of age (or the higher applicable age), you are prohibited from registering an account and using the Services offered.
If we discover, through reliable means, that a User is under 18 years of age (or the applicable legal age), we may cancel that User’s Account or their access to the Site, as well as withhold any winnings existing in the balance.
It is your responsibility to access and use the Site and the Services in accordance with the Terms, the applicable legal restrictions, the Responsible Gambling Policy (see section 13) and all relevant laws and regulations.
The Site is intended solely for private use and recreational purposes.
The Site:
Provides information about the main official national lotteries (hereinafter, “Lotteries”) administered by independent operators (hereinafter, “Lottery Operators”);
Enables registered Site users (“Users”) to acquire, through agency and technological intermediation, participations in authorized games operated by third parties. This includes purchasing tickets for draws (“Ticket Purchase Service”) and playing games virtually with randomly generated numbers, including, among others, scratch-and-win cards (“Instant Prize Games” or “IPG”) and lottery-style games.
Offers various Services (defined below) to Users, all subject to these Terms.
The Site displays a complete list of the Lotteries for which we offer our Messaging Services and the schedule of each Lottery Draw, as well as a complete list of the available instant prize games and their corresponding payouts.
Subject to the applicable registration requirements and compliance with these Terms, we offer certain services related to the Site (“Services”), including, without limitation, the Ticket Purchase Service, the Ticket Viewing Service, the Group Play Service, the Lottery Raffle Service, the Prize Collection Service, the Subscription Service, Instant Prize Games and the Complaints and Disputes Service.
We grant you permission to access and use the Site, provided that you comply with these Terms and applicable law, and that you do not: (a) copy, distribute or modify any part of the Site without our prior written authorization; (b) use, modify, create derivative works from, transfer (by sale, resale, license, sublicense, download or otherwise), reproduce, distribute, display or disclose Content, except as expressly authorized herein; (c) disrupt servers or networks connected to the Site; (d) use or launch automated systems (including, without limitation, “bots” and “crawlers”) to access the Site; (e) use the Site’s communication systems to send unsolicited or unauthorized commercial communications; (f) use the Site for fraudulent or deceptive purposes; (g) circumvent, disable or otherwise interfere with Site features related to security, or with features that prevent or restrict the use or copying of any Content or that impose limitations on the use of the Site. We reserve all rights not expressly granted in and to the Site.
To use our Services, it is necessary to create an account (“Account”) and provide mandatory information related to it. You may choose whether or not to submit this information; however, if you choose not to provide the mandatory information, you may be unable to register an account or use some of the available Services.
By applying to open an Account, you agree to comply with these Terms and Conditions at all times. In addition, you warrant and represent that:
When creating your Account, you must provide accurate and complete information, including your full name, date of birth, residential address and city, contact email address and personal telephone number. You must subsequently keep this information up to date.
It is your responsibility to provide correct personal information. We reserve the right to immediately close your account and to refuse, withhold or void payments if we detect that you have provided false information about your personal data, such as your age, whether intentionally or not.
You must provide a valid email address and a correct telephone number. We may verify this information through a validation link sent to your email address or an SMS to your telephone number. We reserve the right to suspend your account if we are unable to satisfactorily verify your contact details.
When creating your Account, you will be assigned a username based on the email address provided and will be asked to choose a password. You are solely responsible for the activity on your account and must protect your account details, including your password, as well as any associated email address, your computer and the device from which you access your account (including, without limitation, by securing passwords and locking the screen). It is recommended that you log out after each gaming session and not leave your mobile device unattended in order to prevent unauthorized use of your account. You must notify Fortu immediately of any security breach or unauthorized use of your account; in no event will Fortu be liable for unauthorized use of your Account that is not attributable to Fortu’s fault. For the avoidance of doubt, any bet placed from your account will be deemed to have been made by you and will be accepted and considered valid.
Furthermore, if you are: (a) an employee, director, officer or agent of Fortu or any affiliated entity; (b) a person involved in the administration or operation of a Lottery Draw, including employees of a Lottery Operator; (c) the spouse, civil partner, parent, sibling, child or close relative of any of the persons mentioned or related above, you are prohibited from registering an account or participating in any of our services.
We reserve the right to deny access to users about whom there is any suspicion in relation to the foregoing point.
To use certain functionalities of the Site, including deposits, withdrawals, transfers and payments associated with the Services, the User may register bank accounts, BreB keys or other financial identification mechanisms enabled by financial entities or authorized payment service providers. The User declares and warrants that: a) they are the legitimate holder of the registered bank accounts and keys; b) the financial information provided is truthful, accurate and up to date; c) they authorize Fortu and/or its technology providers and payment processors to carry out ownership validations, authentication, transaction verification and security controls on the registered financial means. Fortu may reject, suspend or limit the use of any BreB key, bank account or payment method when it detects inconsistencies, fraud risks, identity theft, suspicious activity or regulatory non-compliance. The User acknowledges that services associated with BreB, bank transfers and other financial infrastructures depend on third parties outside Fortu, and therefore Fortu does not guarantee continuous availability, specific processing times or the absence of operational failures attributable to financial entities, transactional networks or technology providers. Fortu is not a financial entity, does not hold money as a bank, and uses authorized third-party infrastructure for security purposes, including, for example: a) Payment gateways, b) BreB, c) ACH, d) PSE, e) Partner banks.
Fortu administers users' accounts, managing available funds, pending funds, wagering funds, and the amount of winnings. Unless proven otherwise, these amounts are considered final and accurate.
You are limited to holding only one active Account at any time. You are permitted to make deposits or withdrawals to your Account in accordance with Sections 7 "Transfer of Funds to Your Account – Deposits" and 8 "Transfer of Funds from Your Account". It is prohibited to sell, transfer, or acquire accounts from other users, as well as to transfer funds between accounts.
Accounts do not bear interest. No interest will be paid on funds in your Account, regardless of the amount. Fortu does not consider itself, nor does it purport to be, a financial institution.
With respect to your Account, we reserve the right, at our sole discretion, to:
Refuse to open an account or close an existing account without being required to justify such decision. In such case, any contractual obligations already established will be honored.
Reject deposits without providing a justification.
Verify to our satisfaction, by requesting documents or other evidence, your identity and the personal data provided upon registration on the Site, as well as your authorization to use a specific payment method. The documentation requested may include, without limitation, certified copies of photo identification, bank statements, references, utility bills, or receipts. Verification requests may be made at any time, and we reserve the right to suspend or limit your Account until verification is completed.
Confiscate funds available in your Account or reject claims if these Terms have been violated or unauthorized activities related to the operation of your Account have taken place, such as breach of law, violation of third-party rights, fraud, or deception.
Suspend or cancel your participation in games, promotional activities, competitions, or other services if we consider that your Account may be involved in illegal, fraudulent, or dishonest practices, including promotion abuse.
Verify to our satisfaction any unused funds in your Account.
Monitor your gaming and transaction activity.
Request additional information about you, including your involvement in political or public functions, your commercial profile, sources of income, and relevant documentation supporting such information, as well as carry out any other activity required by applicable anti-money laundering and counter-terrorism financing legislation.
Fortu may carry out financial validation and payment method verification processes for the purpose of preventing fraud, identity theft, unauthorized transactions, money laundering, terrorism financing, and any other illicit or irregular activity related to the use of the Site and the Services. As part of such processes, Fortu may: a) verify the ownership of bank accounts, cards, BreB keys, and other financial instruments registered by the User; b) request additional documentation, biometric validations, identity confirmations, or proof of ownership; c) limit, reject, suspend, or temporarily withhold transactions, deposits, withdrawals, or Account functionalities where there are reasonable indications of risk, fraud, inconsistencies, or suspicious activity; d) conduct transactional monitoring and automated analysis of financial behavior; e) rely on technology providers, financial entities, payment processors, and third-party validation systems to execute security controls and authentication. The User expressly authorizes Fortu to carry out the necessary validations related to the payment methods and financial services used within the Site. Fortu reserves the right to report suspicious activities to the competent authorities when required by law or when there are reasonable indications of fraudulent or illicit activities.
An Account will be considered inactive if no login, logout, or wager is recorded during a consecutive period of twelve (12) months.
We will notify you by email to the address registered in your Account when it is about to become inactive. The notification will be sent up to thirty (30) days before your Account is considered inactive.
Fortu may use electronic records, authentication validations, IP addresses, associated devices, transactional logs, digital confirmations, and other technological evidence as proof of the authorization and execution of transactions carried out by the User.
The User's Account within the Site corresponds exclusively to a technological tool for registration, execution of instructions, and operational administration related to the Services offered by Fortu. The funds delivered by the User do not constitute financial deposits, savings accounts, fund-raising products, investment instruments, or regulated financial services. Fortu does not act as a financial entity, credit establishment, trust company, public fund-gathering institution, or as an institution supervised by the Superintendencia Financiera de Colombia. The funds available in the Account: a) do not generate interest, returns, or profits; b) are not covered by deposit insurance; c) may only be used for the execution of instructions related to the Services enabled within the Site. Fortu may rely on financial entities, payment gateways, technology providers, and third-party interoperable systems for the execution of payments, validations, deposits, and withdrawals.
When an Account becomes inactive, a monthly administrative fee of up to five thousand pesos (5,000) will be deducted. This fee will only be deducted if your Account has available funds.
To deposit funds into your account, you may use one of the available deposit methods. Information on the available methods, including deposit limits, processing times, and accepted currencies, can be found in the Banking section of the app. Once your account is registered, you may make an online deposit by clicking the "Deposit" button and following the instructions. Fortu does not charge a handling fee for deposits.
You acknowledge and agree that if (a) you choose to carry out a transaction on the Site (for example, paying the cost of an order or purchasing an instant-prize Game) with your credit card; or (b) there are insufficient funds in your account to cover a transaction you have made, Fortu may charge that credit card or the credit card designated in your account, and you authorize the charge to that card (or any replacement card).
If you choose to use the Subscription Service to place recurring orders, we may charge order prices through recurring payments using the payment method you have designated (including a credit card). In such case, Fortu may make periodic charges without requiring further authorization from you, and such authorization will remain in effect until you cancel it.
You agree: (a) to provide only valid and relevant billing and credit card information; (b) that we may use tools, software, or services of third-party providers to process transactions on our behalf; (c) that you will be responsible for any processing fees charged by the card issuer in connection with payments and recurring payments; (d) that, except as expressly set forth in these Terms, all orders and purchases are final and non-refundable; (e) if we do not receive payment for any reason from your card issuer, you agree to promptly pay all amounts owed upon request, and Fortu may charge a reasonable fee for rejected payments; and (f) any failure or inability of Fortu to process a payment does not relieve you of your payment obligations.
We reserve the right to impose conditions on the use of certain payment methods and to modify the available methods without prior notice. We do not guarantee that all payment methods will be available at all times.
Except as expressly set forth in these Terms, you acknowledge and agree that any amount paid to Fortu in connection with your use of the Site and any Service, including order prices, wagers, and instant-prize games, is non-refundable.
If you reasonably believe that we have made an incorrect charge, you may notify us and request a refund. The tools in your account should allow you to do so, and in any case you may contact us through our Customer Service. Please note that we will not consider refund requests without all the details of the disputed transaction, including the relevant dates, payment details, and a brief explanation of the reason for the dispute. If we determine, at our discretion, that the amount has been incorrectly charged, we will refund that amount as the sole remedy; the submission of a reversal request does not imply automatic acceptance of the claim.
If you are not completely satisfied with our services after your first purchase, you are entitled to request a full refund of that purchase. You may contact Customer Service to request it, providing full details of the purchase, including the date, payment details, and a brief explanation of your dissatisfaction. Our money-back guarantee applies only to your first purchase on the Site and not to subsequent purchases. You may request this refund up to six months after your first purchase.
Some deposit and withdrawal methods may operate through the BreB system or other interoperable transfer mechanisms enabled by financial entities or authorized providers. The use of such tools will be subject to the operational availability of the participating entities, as well as their terms, validations, and processing times.
In the cases provided for by applicable Colombian legislation, the User may request the reversal of payments made through the Site when: a) the User has been the victim of fraud; b) the transaction corresponds to an unsolicited operation; c) the product or service purchased was not received; d) the transaction was processed incorrectly; e) any other legally applicable ground exists. Reversal requests must be submitted within the time limits established by current legislation and must include the information and supporting documents required for their analysis. The User acknowledges and agrees that reversal of payments will not be available when: a) the purchase mandate has already been executed; b) the lottery ticket, participation, or purchase instruction has already been acquired by the authorized representative; c) the intermediation service has been rendered in whole or in part; d) there are indications of bad faith, abuse, fraud, or misuse of the reversal mechanism. Fortu may temporarily suspend the Account, withhold funds, or limit functionalities while a reversal request or a financial claim related to a transaction is being analyzed. The User authorizes Fortu to share transactional, contractual, and authentication information with financial entities, payment gateways, technology providers, and competent authorities when necessary for the management of disputes, reversal processes, fraud prevention, or legal compliance.
During your use of the Site and the Services, the following types of money or credit may be transferred to you or to your account: (a) prizes; (b) participations or shares of a prize from a Group ("Group Prize"), ("Group Draw"); (c) the cash value of money you deposit into your account for use on the Site ("Deposits"); (d) bonuses, including promotional funds administered in the form of bonuses, such as cash refunds; (e) refunds. Prizes, Group Prize participations, deposits, and refunds are collectively referred to as "Real Money". Bonuses are credited to your account and referred to as "Bonus Money". Your right to receive Real Money or Bonus Money is subject to these Terms. Bonus Money deposited into Users' accounts will be valid for a period of six (6) months from the date of deposit. At the end of this period, the Bonus Money will be removed from the user's account with prior email notification. (f) Funds are delivered under an agency mandate and will be managed in accordance with your instructions. (g) Bonuses are or may be promotional discounts; they are not withdrawable money, do not equate to real cash, and do not give rise to any property rights.
Use of Real Money: Real Money is transferred to your account and may be used in connection with your future transactions on the site (for example, to place orders, purchase an instant-prize Game, or participate in a Group Draw). You may withdraw any unused Real Money at any time in accordance with Section 9 below.
Use of Bonus Money: Bonus Money is credited to your account and may only be used in connection with your future transactions on the site (for example, to place orders or purchase an instant-prize Game). You may not withdraw from your account the money or monetary value of unused Bonus Money.
Bonus Credit does not count as Deposited Money for the purpose of your deposit limit, but it does count as Spent Money for the purpose of your spending limit.
If you place an order or purchase an instant-prize Game through the site, any Bonus Money available in your account will be charged first. If the Bonus Money is insufficient to cover your transaction, any Real Money you have in your account will be debited.
You may use the site's tools to withdraw the Real Money available in your account by selecting your preferred withdrawal method. The average time to process a withdrawal is approximately 3 business days. If your account is limited or pending verification in accordance with Sections 3 and 6 above, processing may take longer. Additional information about withdrawing Real Money is displayed in the app.
Withdrawals will be remitted to the same account from which the funds deposited into the user's account originated. Where this is not possible, Fortu will remit the funds to the Player in accordance with the requirements of applicable legislation. If you wish to withdraw funds from a blocked, closed, or excluded account, you must contact soporte@fortu.com.
Before you are permitted to withdraw funds deposited into your account, you must have placed at least one order or purchased one instant-prize Game, but which have not been used to place an order or purchase an instant-prize Game.
You will be solely responsible for the notification and payment of all taxes and charges arising from, or imposed on, the amounts paid or transferred to you by the Site under these Terms. You acknowledge and agree that the Lottery Operator or the Lottery Raffle Operator may withhold a portion of your prize or participation in a Group Prize and remit it to the relevant tax authority on your behalf.
To the extent that we credit or transfer any amount to you under these Terms, we will do so in the same currency that you have designated in your account for making payments to Fortu.
Each lottery draw or lottery raffle draw is conducted by the corresponding Lottery Operator or Lottery Raffle Operator. Your participation in each draw is subject to the terms and conditions of the Lottery Operator or the Lottery Raffle Operator ("Lottery Operator Rules"). Although we provide a detailed general description of each lottery on the Site, by placing an order you agree to independently review and comply with the relevant rules.
Lottery Ticket Service
We (a) provide tools on the Site for users to complete and submit online orders in connection with messenger services for lottery draws ("Orders"); (b) acquire the ticket on your behalf through digital tools or in some cases engage local representatives to purchase lottery tickets on behalf of users from Lottery Operators according to the User's Order ("Local Representative"; "Lottery Ticket"); (c) display lottery draw results on the Site; (d) where applicable, collect winnings from Lottery Operators and credit the prize to the account of an eligible user (prize winner); (e) where applicable, facilitate the in-person delivery of a winning lottery ticket to eligible users (prize winners) (collectively, the "Lottery Ticket Service, My Tickets, Tickets")
To participate in the Lottery Ticket Service, the Group Draw Service (defined in Section 9.6) or the Lottery Raffle Fraction Service (defined in Section 9.8), you must (a) have registered a valid account and maintain an active account; and (b) comply with these Terms. A user who complies with these Terms and legally purchases a lottery ticket, a participation in a group draw, or a tenth (fraction) of a lottery raffle through our messenger services shall be the owner of the lottery ticket, participation, or lottery raffle tenth purchased from the moment of ticket purchase on behalf of the user and, with respect to participations in group draws or Lottery Raffle fractions, from the moment of successful completion of the transaction pursuant to Section 9.14.
To use our messenger Service to participate in a lottery draw, a Group Draw, or a Raffle, you must use the site tools to (a) complete an Order by selecting the lottery form type and inserting your numbers on each line or choosing the Lottery Group type and the number of participations (fractions, fracciones), or choosing the Lottery Raffle and the number of shares (as applicable); (b) submit the completed Order; and (c) pay the price for submitting the Order ("Order Price"). The completion, submission, and payment of an Order shall be collectively referred to as "Placing an Order" or "Making a Purchase".
The Site allows players to purchase participations in a possible future prize derived from a pool of lottery tickets ("Group Play" or "Group Play Service"). The Group Play Service does not allow you to choose the Group members, and Fortu does not participate financially in the prize nor does it acquire any rights over the prizes.
A Group Draw game offers you the opportunity to purchase one or more equal shares of ownership in a Group ("Participations/Shares"), (shown as a percentage of share ownership), to the extent that such Participations are available. We determine: (a) the total number of Participations available for purchase in a Group Draw, ("Total Participations") or (Total Tickets); (b) the number of lottery tickets purchased by the group; and (c) the number combinations played by the lottery tickets ("Lines") purchased by the Group. The Site will display the Total Participations, the Lines played, and the remaining Participations available for purchase before the purchase of any Participation. Fortu acts solely as a temporary custodian.
When purchasing a Participation, you will not own any specific Lottery Ticket or Line purchased by the Group. Instead, these will be owned by us as administrator of the Group. The portion due to you of any Prize resulting from winning lottery tickets purchased on behalf of a Group ("Group Draw Prize") shall correspond to the percentage of Participations you have purchased out of the Total Participations in that Group Draw.
Lottery Raffle Ticket Service
The Site allows players to purchase official lottery raffle tickets in the country's largest lottery raffle draws (the "Lottery Raffle Ticket Service") provided by independent official lottery raffle operators. To the extent that such fractions ("Lottery Raffle Fractions") are available, the following will be predetermined: (a) the lottery raffle tickets for which fractions or fractions are available; (b) the number of fractions available for each lottery raffle ticket; and (c) the pre-printed numerical codes of the lottery raffle tickets. The Site will display the total lottery raffle fractions, and the remaining fractions available for purchase on each raffle ticket prior to the purchase of any lottery raffle ticket.
In the event of a Participation in a Lottery Raffle Ticket, if such Ticket is a Winning Ticket, you may be entitled to a prize ("Raffle Prize or Draw Prize") paid by the Lottery Raffle Operator. The prize amount is determined solely by the lottery raffle operator. The portion due to you of any prize resulting from a winning lottery raffle ticket shall correspond to the number of lottery raffle fractions you have purchased out of the total number of available fractions. The per-tenth payment for the lottery raffle is displayed on the Site. All lottery raffle fractions that have not been purchased by Site users will be returned to the Lottery Raffle Operator, (only in cases that so require).
Order Price and Payment Confirmation
The Order Price (a) is the amount displayed on the Site at the time you submit the Order; (b) includes our service fee and may therefore be higher than the participation price you would pay if you submitted an equivalent lottery form or acquired an equivalent participation directly from the Lottery Operator or the Lottery Raffle Operator; (c) is subject to change, as displayed on the Site; and (d) is subject to the number of lines and numbers or the number of lottery raffle fractions of the Order (as applicable) that you choose to submit and the number of lottery games in which you choose to participate.
Service Price Payment Confirmation a) Confirmed Payments: Once we receive the Order Price, we will send you a payment confirmation by email; you will also be able to access order information within the Site and view information about your ticket, group participation, or lottery raffle participation, including payment details and the name and date of the draws, in your account. b) Pending Payments: In the unlikely event that there is a delay in payment (for example, due to technical issues in processing a transaction) between the submission of an Order and the payment of the Order Price, the transaction status will remain pending until we receive payment.
We stop accepting Order submissions for the Lottery Ticket Service and the Group Service a certain number of hours before the Lottery Operator conducts the draw ("Cut-off Time"). We display on the Site the amount of time remaining until the Cut-off Time for each draw. We reserve the right, at our sole discretion, to determine the duration of the Cut-off Time. Once the deadline has expired for a draw, you will no longer be able to submit an Order.
Upon receiving an Order and the Order Price, we proceed to make the purchase digitally or engage a Local Representative to purchase, on behalf of the User, the corresponding lottery ticket from the Lottery Operator. We use commercially reasonable efforts to ensure that each ticket meets the deadlines set forth in the Lottery Operator Rules. You acknowledge that, since Lottery Tickets are purchased locally immediately after the Order is submitted, there is no option for timely cancellation, and you agree that your Order and the payment of the Order Price are final, non-cancellable, and non-refundable (except as expressly set forth in these Terms). In the event of any inconsistency between the numbers appearing on an Order and a Lottery Ticket, the numbers on the Lottery Ticket shall prevail.
You may view scanned or digital copies of your lottery tickets or your lottery raffle fractions in your account ("View Your Ticket Service"). Because the scanned copy could be misused, we may reserve the right to replace it in some cases with a graphic representation of the purchased ticket containing the same material elements.
We reserve the right to refuse, limit, or cancel any Order placed through the Site, as well as to refuse or limit the provision of any Service. No charge will be made for any Order that is not accepted.
After each lottery draw, the operator publishes the final winning numbers ("Winning Numbers"). In the event that your lottery ticket includes winning numbers, you may be entitled to a cash prize paid by the Lottery Operator ("Prizes"). The number of winning numbers required and the prize amount are determined solely by the operator. We use commercially reasonable efforts to publish official draw results, including winning numbers and prizes, on the Site as soon as possible after official publication. If your lottery ticket is a winning ticket ("Winning Lottery Ticket"), we will send an email to your designated account and, if you have chosen to participate in our Alert Service, an SMS to your mobile phone number notifying you that the ticket is a Winning Lottery Ticket.
The Site distinguishes between the following prize categories: (a) the jackpot in a particular lottery or lottery raffle draw ("Jackpot, Accumulated Prize, First Prize, Grand Prize"), prizes subject to local taxes in the jurisdiction of the lottery operator or the lottery raffle operator ("Locally Taxed Winnings"), and prizes of more than COP 10,000,000; and (b) prizes that are neither the jackpot nor Locally Taxed Winnings ("Secondary Winnings").
Prizes, participations, winnings, and payments derived from lottery tickets, raffles, group draws, or other services available on the Site may be subject to taxes, withholdings, contributions, mandatory deductions, and other applicable tax charges pursuant to current Colombian law and/or the applicable rules in the jurisdiction of the corresponding operator. The User acknowledges and agrees that: a) lottery operators, raffle operators, financial entities, or competent authorities may apply automatic withholdings or mandatory deductions on prizes and payments; b) tax rates, withholding percentages, and tax obligations may change at any time due to regulatory or normative changes; c) Fortu does not guarantee specific tax rates nor does it act as the User's tax, financial, or legal advisor; d) the User shall be solely responsible for fulfilling their personal tax obligations arising from prizes or funds received. Fortu may provide the User with general information related to applicable deductions or withholdings; however, such information shall be purely informational in nature and shall not constitute tax advice.
If you win a jackpot, Locally Taxed Winnings, or a prize exceeding COP 10,000,000, you will be responsible for claiming the prize directly from the lottery or raffle operator as stipulated in Clause 9.23. However, Fortu may, at its sole discretion, offer to manage the prize claim on your behalf and transfer it to you (the "Prize Collection Service").
If you are awarded Secondary Winnings of up to COP 10,000,000 or any prize from a Group Draw, you agree that the lottery or raffle operator will collect the prize on your behalf and transfer it to your account through our prize collection service.
You acknowledge and agree that (a) if we collect the prize, the Group's shared prize, or the raffle prize on your behalf and transfer it to your account, we may deduct the costs associated with the bank transfer from the prize amount; and (b) the lottery or raffle operator may deduct taxes, withholdings, or other sums from the prize amount, Group participation, or raffle prize, in accordance with the operator's rules; c) the amounts credited to the User may correspond to the net value actually received after withholdings, taxes, or discounts applied by operators, financial entities, or competent authorities.
We make every effort to transfer the prize, the Group prize participation, or the raffle prize to you as soon as we receive the prize or participation from the corresponding operator. If the operator does not deliver the prize, participation, or raffle prize, (a) we will have no obligation to credit the corresponding amount to your account; and (b) in the case of a winning ticket, we will provide you with the ticket so that you may collect the prize directly from the operator.
If you must collect the prize personally from the lottery or raffle operator, we will coordinate with one of our representatives to deliver the winning ticket to you at a designated location in the operator's city ("Territory"). You must cooperate with Fortu or its representative to facilitate the collection. Before receiving your ticket, you must sign a legal waiver declaring (a) that you have received the winning ticket; (b) that you are responsible for claiming the prize directly; and (c) that you waive any claim against Fortu and its representative with respect to the prize. Fortu shall have no obligation to pay an amount equivalent to any amount the operator may fail to pay.
Fortu reserves the right to require players who win prizes exceeding COP 300,000,000 to participate in a public award ceremony and/or interviews at Fortu's discretion, although the player may always choose to remain anonymous.
If you are not in the "Territory" (city or department), you must travel there to claim the prize, participation, or raffle prize ("Travel"). You are responsible for all related costs, such as travel, accommodation, and subsistence, except to the extent set forth in Section 9.27.
Notwithstanding Section 9.26, if you are entitled to a prize exceeding COP 30,000,000, a participation in a Group Draw prize, or a lottery raffle tenth exceeding COP 300,000,000; and (a) you do not reside in the Territory; and (b) you are required to travel to the Territory, Fortu will cover your reasonable travel expenses, at our sole discretion. Payment of these expenses may be subject to your participation in marketing activities related to the prize in the prize delivery Territory.
If you travel to claim your prize, you must have (a) all necessary permits to enter the Territory (if required); (b) travel insurance (covering medical claims, injuries, and losses); (c) all necessary vaccinations and medical clearances; and (d) compliance with the lottery or raffle operator's rules requiring the presentation of certain documents. Your failure to comply with these requirements may prevent you from claiming the prize. Travel is at your own risk. You waive any claim against Fortu with respect to (a) any travel-related incident; and (b) your inability to meet the travel requirements, including the inability to claim the prize.
You acknowledge that the order price for each lottery draw may vary for various reasons, including: (a) fluctuations in service costs, as the amounts displayed on the site are based on values relating to the cost variables of the offers and prizes of the lotteries (Lottery Operators); (b) changes in the price charged by the lottery operator for its tickets; or (c) adjustments to our service fees.
You agree that we may automatically debit your account in connection with your participation in the Subscription Service. If your account does not have sufficient funds to cover your participation, then (a) we will charge the designated payment method you have provided (for example, your credit card), and you authorize us to do so; or (b) we will not proceed with the purchase of your lottery ticket on your behalf and will notify you by email that the transaction was not completed due to insufficient funds.
Instant Prize Games.
The Site allows users to acquire, through technological mandate and intermediation, participations in authorized games operated by third parties such as scratch cards, where you may purchase one or more participations. The amount wagered on each instant game, including service fees (the "Wager"), is displayed in the corresponding section of the site. The potential prize for each instant game is also displayed in that section.
Each instant game has a different Wager, prizes, and pay table (the "Instant Prize Game Prize"). The rules and pay tables for all instant games are available in the dedicated section of the site. We recommend reading the rules carefully before making a purchase.
To purchase an instant game through our services, you must use the site tools to (a) select the type of game you wish to acquire; (b) submit the order; and (c) pay the Wager. This process is referred to as "Purchasing an Instant Prize Game".
If the instant game participation is not played within two months of purchase, we reserve the right to play the game on your behalf, cancel the game, or take any other discretionary action. Any prize won will be transferred to your account.
If you win an instant game, the prize will be transferred to your account. You agree that the prize may be subject to taxes, charges, and deductions, and you are responsible for reporting and paying all applicable taxes and charges.
The User acknowledges and agrees that Fortu acts exclusively as a technological agent and intermediary for the execution of purchase instructions related to lottery tickets, group participations, and other services enabled on the Site. The mandate conferred by the User shall be deemed executed once: a) the purchase instruction has been processed by Fortu; b) the authorized representative has acquired the corresponding ticket, participation, or right from the official operator; or c) the transaction has been confirmed within the operating and technological systems used by Fortu for the execution of the service. Once the mandate has been executed: i) the intermediation service shall be deemed rendered; ii) the User shall acquire the corresponding ownership of the ticket, participation, or right acquired, as applicable; iii) the transaction may not be cancelled, reversed, or modified, except as required by mandatory law or as expressly provided in these Terms. The User acknowledges that the execution of the mandate may occur in an automated manner, immediately, or through internal operational processes carried out by Fortu and/or authorized third parties.
Occasionally, we may offer bonuses or other promotional offers. All bonuses and Promotions are subject to these Terms of Use, as well as their specific terms and conditions, which will be provided together with the description of each promotion. By participating in any bonus or promotional offer, you fully accept the general and specific terms and conditions. It is your responsibility to read and understand the Terms of Use before accepting any bonus or promotion.
If the processing of an order or purchase is interrupted due to a system failure and cannot be completed, the amount of the order or purchase will be refunded to your Account.
We reserve the right to cancel orders and purchases without prior notice if we deem it necessary due to software errors or other problems.
If any information, including probability tables and payouts, is published incorrectly on the Site, we will take steps to correct and adjust the data in our system to reflect the correct information. Any winnings affected by the incorrect information will also be adjusted accordingly.
12.1. Fortu has official customer support channels for inquiries, requests, reports, petitions, complaints, claims, technical support, and assistance related to transactions, validations, prizes, withdrawals, and the operation of the Site. Official support channels may include: a) support email; b) contact forms within the Site or the application; c) online live chat; d) telephone lines or additional channels enabled by Fortu. Official support hours will be posted on the Site and may be modified at any time. Fortu will handle requests within reasonable timeframes in accordance with the nature of the requirement and applicable consumer protection legislation. The User acknowledges that certain requests related to financial validations, banking institutions, lottery operators, technology providers, or authorities may require additional processing time. Fortu will never request full passwords, authentication codes, banking credentials, tokens, dynamic keys, or confidential information through unofficial channels. The User is responsible for verifying that they interact only with official channels authorized by Fortu.
12.2. Every petition, complaint, claim, or request submitted by the User must contain sufficient information to identify the Account and the reason for the request. Fortu may request additional documentation or information when necessary to validate the User's identity or to analyze the reported case. Requests will be handled within the timeframes established by applicable Colombian legislation on consumer protection and electronic commerce. Fortu may extend response times when: a) validations with third parties are required; b) anti-fraud verifications are needed; c) we depend on information from lottery operators, financial institutions, technology providers, or authorities; d) technical or security incidents exist. If suspicious activities, fraud attempts, impersonation, or material inconsistencies are identified, Fortu may temporarily suspend processes, transactions, or functionalities while the corresponding investigation is completed.
If you remain unsatisfied after our attempts to resolve the dispute, you may submit your concerns to the alternative dispute resolution service before the SIC, consumer protection bodies, or conciliation mechanisms under Colombian jurisdiction.
Alternatively, you may escalate the matter directly to the Support Unit of the Superintendencia de Industria y Comercio.
We will inform you or the Authority of the results of our investigation within 30 business days of receipt of the complaint.
The User acknowledges that the security of communications is a shared responsibility. Fortu may send communications related to the Account, transactions, validations, security alerts, prizes, withdrawals, and the operation of the Site via email, SMS, push notifications, calls, or channels enabled within the application. The User shall be responsible for keeping their contact information up to date and for protecting access to their devices, email accounts, and authentication methods. Fortu shall not be liable for losses arising from unauthorized access caused by the User's negligence, voluntary disclosure of credentials, external fraud, malware, phishing, impersonation, or breaches beyond Fortu's reasonable control.
Fortu is committed to promoting a responsible approach to betting and gaming, and in this regard: (a) we prohibit any person under the age of 18 (or the applicable legal age in their country) from registering an Account, using our Services, or purchasing instant games; (b) we recommend that all Users set limits on their participation in lottery draws and in the purchase of instant games; and (c) we advise against using lotteries or instant games as a source of income or as a means of recovering debts. If you believe you are using our Services irresponsibly, we recommend that you stop using them and close your Account using the tools available on the Site.
If you wish to increase an exclusion or decrease a financial limit, these changes will take effect immediately upon receipt of notification. If you wish to increase a financial limit, the change will take effect twenty-four (24) hours after receipt of the request.
The Site provides information and links to organizations that can assist with gambling-related issues, including resources and self-assessment tools. If you are concerned about your participation in lotteries or instant games, we encourage you to seek help through these resources available on the Site.
We are committed to doing everything possible to enforce our responsible gambling policies and to provide support and guidance in the use of our responsible gambling tools. However, we accept no liability if you continue to gamble and/or deliberately attempt to circumvent the measures in place, or if we are unable to enforce such measures for reasons beyond our reasonable control.
The Site may contain links to third-party websites that are not owned or controlled by us. We are not affiliated with these sites and assume no responsibility for the content, privacy policies, or practices of any such websites. You expressly release Fortu from any liability arising from your use of any third-party website. We recommend reviewing the terms and conditions and privacy policy of each third-party website you visit.
This section applies regardless of whether the services offered on the Site are free or paid. Applicable law may not permit the exclusion of certain warranties, so some exclusions set forth herein may not apply.
The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied. Fortu disclaims all warranties, express or implied, including, without limitation, implied warranties of merchantability, title, fitness for a particular purpose, non-infringement, and those arising by operation of law or from a course of dealing.
Therefore, Fortu does not warrant that:
The Site will be available at specific times or for specified periods.
The features, functionality, or performance of the Site will meet the expectations of the User or third parties.
The Site or its features and functionalities will be compatible with the device or system the User employs to access the Site.
Alert or subscription services (and/or any other service) will be delivered before the indicated deadline.
Fortu shall not be liable for Services that are incorrect, delayed, or not received by the User.
Fortu does not warrant that the Site is free from errors, security vulnerabilities, or viruses. The Site may occasionally be unavailable due to routine maintenance, updates, or other reasons. You agree that Fortu shall not be liable for any consequences arising from Internet technical problems, slow connections, traffic congestion, server overloads, transmission delays or failures, or any other alteration or distortion of data.
We do not guarantee, endorse, or vouch for any content, product, game, or service offered or advertised on the Site by third parties.
Fortu shall not be liable for losses or damages caused by the insolvency of third parties, including banks that hold Fortu's accounts.
You agree that Fortu shall not be liable for:
Failures or malfunctions of your Internet service provider's equipment or technology.
Losses or damages arising from any aspect of the Site or its availability or functionality that is not under Fortu's control.
The refusal to provide services to any person.
Money lost due to incorrect or invalid orders, or from playing instant games.
Losses caused by the misuse or unauthorized use of passwords.
Fortu shall not be liable for lost lottery tickets or raffle fractions, or for failing to submit forms or purchase lottery tickets or raffle fractions, or for administrative errors in lottery tickets or raffle fractions, or for failures in instant games, whether such errors, faults, or mistakes originate from our systems or those of our service providers, or from human error (each referred to as an "Incident"). In the event of an Incident, we reserve the right to cancel an order or participation in an instant game, and our sole liability shall be to refund the price of the corresponding order.
You acknowledge that content related to lottery or raffle draws, including the official results of such draws (collectively, "lottery operator data"), is based on information provided by lottery or raffle operators, and such information may be incorrect, incomplete, or subject to change. We do not warrant the accuracy, currency, or completeness of lottery or raffle operator data, and you agree to verify such data through the official websites or publications of the relevant operator.
Fortu will make reasonable efforts to ensure that published odds, pay tables, results, and prizes are correct. However, we assume no liability for errors, including those discovered after prizes have been paid, such as human errors, malfunctions, or incorrect information provided by lottery operators, raffle operators, or other related sources.
We make no representations or warranties regarding your ability to obtain winning numbers or to be entitled to prizes, prize shares from lotteries or raffles, or in connection with your use of the Site.
Fortu does not warrant that lottery or raffle operators will properly conduct draws, honor tickets, or pay the corresponding prizes. You agree that Fortu shall not be liable for any failure by lottery or raffle operators to perform their obligations. Fortu shall not be obligated to pay prizes if a lottery or raffle operator fails to do so for any reason. You waive any claim or right you may have against Fortu in connection with interactions with lottery or raffle operators.
Fortu is not a lottery operator or a raffle operator and does not offer draws or raffles. Your participation in lottery draws, raffles, and instant games is voluntary and at your own risk. If you have disputes with lottery or raffle operators or with other users in connection with the Site and/or lottery draws, raffles, or instant games, you agree that Fortu shall not be liable for claims or damages arising from such disputes. Fortu reserves the right, but does not have the obligation, to monitor such disputes.
Except as expressly set forth in our Privacy Notice, Fortu makes no representations or warranties regarding the security of information you provide or the activities carried out during your use of the Site.
Fortu shall be liable solely as expressly provided in these Terms and shall have no other obligation, duty, or liability in contract, tort (including negligence), breach of statutory duty, or otherwise.
Fortu acts exclusively as a technological intermediary and agent of the User for the execution of purchase instructions related to lotteries, raffles, and Services enabled on the Site. Fortu does not control or warrant: a) the actual conduct of draws; b) the continuity of products offered by official operators; c) the validity, suspension, modification, or cancellation of draws; d) the publication of results; e) the payment of prizes; f) the availability of services provided by operators, financial institutions, transactional networks, or related third parties. The User acknowledges that the official operators of lotteries and raffles are solely responsible for the administration of their draws, issuance of tickets, game rules, official results, and payment of prizes. In the event of suspension, cancellation, annulment, operational errors, technical failures, regulatory changes, or breaches attributable to official operators or third parties beyond Fortu's reasonable control, Fortu shall not assume any substitute obligations of payment, indemnification, or financial recognition other than as expressly set forth in these Terms.
The operation of the Site and of certain Services may depend partially or entirely on infrastructure, integrations, APIs, networks, platforms, financial institutions, technology providers, interoperable systems, telecommunications services, and third parties beyond Fortu's control. Fortu does not warrant: a) continuous and uninterrupted availability of the Site; b) immediate processing of deposits, withdrawals, or transfers; c) permanent availability of services associated with BreB, payment gateways, banking institutions, or transactional networks; d) the absence of interruptions, delays, rejections, inconsistencies, or technical failures originating from third parties. The User acknowledges that temporary interruptions, maintenance, service outages, additional validations, operational delays, or partial unavailability of functionalities may occur without giving rise to any liability on the part of Fortu where such situations are beyond its reasonable control, as well as events of "Technological Force Majeure," cyberattacks, mass outages, regulatory blockages, DDoS attacks, power failures, or cloud failures.
The provisions of this section shall survive the termination or expiration of these Terms.
Under no circumstances shall Fortu, nor our affiliates, nor our respective officers, directors, employees, licensors, assignees, or agents be liable for any loss of money, costs, expenses, goodwill, reputation, special, indirect, direct, incidental, punitive, or consequential damages arising out of these Terms or the use of or inability to use the Site and/or the Services, even if Fortu has been informed of the possibility of such damages. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the foregoing limitations may not apply in your case.
These Terms shall remain in effect until terminated by Fortu. Fortu reserves the right, in its sole discretion, to suspend your access to the Site or any portion thereof immediately at any time (including, without limitation, for a violation of these Terms). Fortu shall not be liable to you or to any third party for the termination of your access to the Site or any portion thereof. If you disagree with any term or condition of these Terms, or with any modification thereof, or if you are not satisfied with the Site, your sole remedy is to immediately discontinue your use of the Site. Upon termination of these Terms, you must cease all use of the Site. Any provision that by its nature should survive shall remain in effect after the termination of these Terms.
These Terms and any rights and licenses granted hereunder may not be transferred or assigned by you, but Fortu may assign them without restriction or notice.
Fortu reserves the right to discontinue or modify any aspect of the Site at any time. The Site Terms and the relationship between you and Fortu shall be governed by and construed in accordance with the laws of Colombia, without regard to its conflict of law principles. You waive the right to a jury trial or to participate in a class action lawsuit. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms. These Terms constitute the entire agreement between you and Fortu with respect to the Site. If any provision of these Terms is found to be invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and a party's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. You agree that any cause of action relating to the Site must be commenced within one (1) year after the cause of action has accrued. Otherwise, such cause of action shall be permanently barred.
All content available on the Site, including texts, documents, descriptions, products, technology, software, graphics, images, sounds, videos, interactive features, and Services (hereinafter, the "Content"), as well as the trademarks, service marks, and logos appearing thereon (hereinafter, the "Marks"), are the property of Fortu and/or its licensors. Such content may be protected by copyright, trademark, patent, or other intellectual property laws and treaties. The content may include information about lotteries, draws, results, prizes, and associated odds. Fortu and/or its licensors retain all rights not expressly granted on the Site and in the Content.
The content of the Site is provided to you "AS IS" solely for your information and personal use. You may not use, modify, copy, distribute, transmit, sell, license, decompile, or otherwise exploit the content for any other purpose without our express written consent. If you choose to download or print a copy of the content for personal use, you must retain all copyright and proprietary notices included therein. "Fortu" and its logo, as well as other associated marks, are the property of Fortu or its affiliates.
